Terms of Service

1. Acceptance of Terms

By accessing and using the Wander Madeira mobile application and website (the "Services"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Services. The app is provided for your personal, non-commercial use only.

2. Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You must be at least 13 years old to use this service.

An account is optional for most of the Services, including buying Pro. Some features require one: sharing Pro with a travel partner, buying AI token packs and syncing your data between devices.

3. Content and Liability

Trail, spot, weather, and event information is provided for informational purposes only. We strive to provide accurate data but make no guarantees regarding the accuracy, completeness, or timeliness of any information.

Interactive forecasts use Open-Meteo data from DWD ICON-EU and NOAA GFS under CC BY 4.0. We derive experimental cloud signals and interpolate values for display. Classic forecasts use Visual Crossing weather data under its provider license. Open-Meteo · CC BY 4.0 · Visual Crossing

Terrain uses Mapzen / Tilezen tiles with source-specific licenses and credits, including USGS, NOAA and EU-funded Copernicus EU-DEM. The elevation grid is simplified and visually exaggerated by 1.2×; numerical elevations remain in metres above sea level. Terrain source notices

Aerial imagery is provided by Direção Regional do Ordenamento do Território (DROTe), captured in 2018–2019 and licensed under CC BY 4.0. It has been resampled, JPEG compressed and locally colour corrected. Original imagery dataset

Nothing in these Terms or subscription conditions restricts your rights to use CC-licensed weather data, terrain or imagery under its original license, independent of your subscription status. Source attribution does not imply endorsement. Interactive forecast access may vary by subscription; Pro and Premium provide the full available fresh forecast, rather than a guaranteed forecast duration.

Assumption of Risk: Hiking and exploring outdoors involve inherent risks. Always assess conditions on the ground. We are not liable for any incidents, accidents, injuries, or property damage that occur on trails or at spots described in the app.

Public Transit and Bus Information: Public transit lines, timetables, transfer planning, school calendar notices, and walking access estimates (including SIGA, CAM, and Rodoeste networks) are provided for planning convenience based on public data sources. Actual bus operations, routes, and timetables are subject to operator changes, weather conditions, delays, and cancellations. Always verify departures and boarding locations locally.

Trail Permits and Ticket Alerts: Trail status and ticket availability monitoring for government-managed trails (IFCN) are provided for convenience. Ticket availability notifications are informational and do not guarantee permit reservation or constitute an official trail booking. Users are responsible for obtaining valid permits and adhering to all official trail closures and safety directives.

Community Marketplace (Trail Share): The Trail Share marketplace is a platform for the community to connect for ride-sharing and ticket exchange. We do not verify, endorse, or guarantee the accuracy, safety, or legality of any offers posted by users. You agree that Wander Madeira is not responsible or liable for any interactions, transactions, or disputes between users. Any content uploaded to the marketplace is the sole responsibility of the user who posted it. We reserve the right to remove any content that violates these Terms or is otherwise objectionable without prior notice.

4. Affiliate Links and Third-Party Bookings

The Services may display offers for transport, tours, activities, accommodation, or car rental from third-party providers ("Partners"). If you book or purchase through one of these links, Wander Madeira may earn a commission or referral fee, at no extra cost to you.

Any booking, payment, cancellation, or dispute arising from a Partner offer is between you and that Partner, governed by the Partner's own terms and policies. Wander Madeira is not a party to that transaction and is not responsible or liable for the accuracy of Partner offers, the quality of the Partner's service, or any issue arising from your use of it. Partner links that constitute a paid or sponsored placement are labeled as such within the app.

5. Trail and Street-Level Imagery

Certain trail or street-level imagery accessible within the Services (the "JourneyViewer" feature) is sourced from Mapillary and licensed under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0). Nothing in these Terms restricts your rights to copy, redistribute, or adapt such CC-licensed imagery in accordance with the CC BY-SA 4.0 license terms, independent of your subscription status with Wander Madeira.

6. Subscriptions and Payments

Pro is sold through the App Store and Google Play. Depending on the store, it is a pass for a fixed period that does not renew, an auto-renewing subscription, or a one-time lifetime purchase; the store shows which before you buy. By purchasing, you agree to pay the price shown for the option you select.

For auto-renewing subscriptions, cancellation stops future billing. Payments, cancellations and refunds are handled by the store under its own terms. There are no refunds for partial periods unless specifically required by law in your jurisdiction.

You can buy Pro without an account. It is then tied to the device and the store account you bought it with. When you sign in, the purchase is linked to your account and works on your other devices. If you change or reset your device before signing in, contact us with the store order number and we will restore your access after verifying the purchase.

AI token packs are one-time purchases that add AI chat usage for a limited period and require an account. A Pro purchase can be shared with one travel partner in the app; sharing requires an account for both people.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may delete your account at any time in the app via Profile → Delete account. Upon termination, your right to use the Service will immediately cease.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
