1. Acceptance of Terms

By accessing and using the Wander Madeira mobile application and website (the "Services"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Services. The app is provided for your personal, non-commercial use only.

2. Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You must be at least 13 years old to use this service.

3. Content and Liability

Trail, spot, weather, and event information is provided for informational purposes only. We strive to provide accurate data but make no guarantees regarding the accuracy, completeness, or timeliness of any information.

Assumption of Risk: Hiking and exploring outdoors involve inherent risks. Always assess conditions on the ground. We are not liable for any incidents, accidents, injuries, or property damage that occur on trails or at spots described in the app.

Community Marketplace (Trail Share): The Trail Share marketplace is a platform for the community to connect for ride-sharing and ticket exchange. We do not verify, endorse, or guarantee the accuracy, safety, or legality of any offers posted by users. You agree that Wander Madeira is not responsible or liable for any interactions, transactions, or disputes between users. Any content uploaded to the marketplace is the sole responsibility of the user who posted it. We reserve the right to remove any content that violates these Terms or is otherwise objectionable without prior notice.

4. Affiliate Links and Third-Party Bookings

The Services may display offers for transport, tours, activities, accommodation, or car rental from third-party providers ("Partners"). If you book or purchase through one of these links, Wander Madeira may earn a commission or referral fee, at no extra cost to you.

Any booking, payment, cancellation, or dispute arising from a Partner offer is between you and that Partner, governed by the Partner's own terms and policies. Wander Madeira is not a party to that transaction and is not responsible or liable for the accuracy of Partner offers, the quality of the Partner's service, or any issue arising from your use of it. Partner links that constitute a paid or sponsored placement are labeled as such within the app.

5. Subscriptions and Payments

Pro and Premium plans are billed through the App Store or Google Play Store. By subscribing, you agree to pay the fees associated with the plan you select.

Cancellation stops future billing. There are no refunds for partial periods unless specifically required by law in your jurisdiction.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may delete your account at any time in the app via Profile → Delete account. Upon termination, your right to use the Service will immediately cease.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
